Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Expunct API, dashboard, and related services (collectively, the “Service”) operated by Expunct (“Expunct,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

1. The Service

Expunct provides PII detection and redaction APIs and tooling for developers and enterprises. The Service is provided “as is” and we reserve the right to modify, suspend, or discontinue features with reasonable notice.

Accuracy disclaimer: Expunct's detection engine achieves high accuracy using statistical models and pattern matching, but is not guaranteed to detect all sensitive data in all contexts. You are responsible for validating outputs before relying on them for compliance purposes. Expunct is a tool to assist, not replace, human review for high-stakes use cases.

2. Accounts and API Keys

You are responsible for maintaining the confidentiality of your API keys and account credentials. You must notify us immediately at security@expunct.ai if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your credentials.

You may not share API keys between organizations or resell API access as a standalone service without a written reseller agreement.

3. Acceptable Use

You agree not to use the Service to:

• Process content that is illegal, harmful, or violates third-party rights
• Attempt to reverse-engineer the detection models
• Submit content for the purpose of extracting or harvesting sensitive data
• Exceed plan quotas through programmatic abuse or account sharing
• Use the Service in applications that provide detection evasion capabilities
• Engage in any activity that disrupts the Service or its infrastructure (denial of service, excessive scraping, etc.)

We reserve the right to suspend or terminate accounts that violate these terms without refund.

4. Plans, Billing, and Quotas

Paid plans are billed monthly in advance via Stripe. Quotas reset at the start of each billing cycle. If you exceed your plan quota, API requests will be paused until your quota resets or you upgrade.

Paid plans include a 14-day free trial. You may cancel at any time from the billing settings; cancellations take effect at the end of the current billing period with no partial refunds. Refunds for exceptional circumstances are handled at our discretion — contact legal@expunct.ai.

We reserve the right to change pricing with 30 days' advance notice. Existing subscribers will not see price increases until their next renewal after the notice period.

5. Data and Privacy

Content you submit for processing is used solely to perform the requested operation. We do not use your content to train models or share it with third parties except as described in our Privacy Policy. You retain all rights to your content.

If your use of the Service involves processing personal data of EU or UK residents, you may request a Data Processing Agreement (DPA) by contacting privacy@expunct.ai.

6. Intellectual Property

Expunct retains all rights to the Service, including the API, models, documentation, and related technology. You retain all rights to content you submit and results you receive.

Feedback or suggestions you provide may be incorporated into the Service without compensation or attribution.

7. Service Level and Uptime

We target 99.9% API uptime, measured monthly, excluding scheduled maintenance. We do not guarantee any specific uptime for free tier accounts. Paid plan SLA details (if applicable) are specified in your order or plan description.

Expunct is not liable for downtime caused by third-party infrastructure providers, distributed denial-of-service attacks, force majeure events, or actions outside our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by law, Expunct's total liability to you for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

In no event is Expunct liable for indirect, incidental, special, consequential, or punitive damages — including loss of profits, data loss, or regulatory penalties — even if advised of the possibility of such damages.

You acknowledge that PII detection is probabilistic and accept responsibility for implementing appropriate human review for high-risk processing.

9. Indemnification

You agree to indemnify and hold harmless Expunct and its team from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) content you submit that infringes third-party rights; or (c) your violation of applicable law.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately for violation of these Terms, non-payment, or activity harmful to the Service or other users. Upon termination, your data will be deleted according to our retention schedule.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in binding arbitration administered by the American Arbitration Association (AAA), except either party may seek injunctive relief in court.

12. Changes to These Terms

We may update these Terms. We will notify you by email or in-dashboard notice at least 30 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
